The owners have made multiple prom- ises to the city about the future of Duval's. They do not want the establishment to be a nightclub nor will they let it become one. Representatives of another establishment in downtown Sarasota underwent a similar con- version from "wine bar" to nightclub status, but without the promises made by Duval's owners. In that earlier case, the Ivory Lounge became a hot, rockin' spot but also a source of unending complaints from residents about noise inside and outside the club. However, the city planning staff and Planning Board were satisfied not only that Duval's owners do not want to create a nightclub, but also that their promises will remain bound to the property. Any future owner or lessee would have to abide by the promises. With that assertion, the vote in favor of the Duval's request was 5-0. WHIMSICAL DOCKS Another case was similar to Biter's. Mary Lee already had approval to build a café and gift shop at her Museum of Art and Whimsy on the North Tamiami Trail in Sarasota. But she wanted to add a loading dock to enable staff to move artwork, as well as an outdoor bathroom for her ground-keeping crew. Staff recommended approval of this application as well, but there were Planning Board concerns about commercial activity in this single-fam- ily neighborhood.
