Later on May 13, Higginbotham told the News Leader by email that he had discussed the situation with attorney James E. Aker of Sarasota, who has been representing Bob's Boathouse in the restaurant's effort to obtain a Certiļ¬cate of Occupancy from Sarasota County. In a telephone interview with the News Leader on the evening of May 13, Aker said he had no comment on the Health Department matter at that time. "I haven't studied it," he explained. After he has had the opportunity to review whatever formal action the depart- ment takes, he added, he would discuss it with the News Leader. However, Aker did say, "Every time I've been [at the restaurant], nobody's gone in [the pool]."
