The plaintiffs recoiled, called the action pu- nitive and withdrew their offer to settle. When the news got back to the city commis- sioners, they withdrew their instructions to Fournier to hunt for ways to kill the Public Art Committee and decided to pay the at- torney's fees from the city's general fund.

At press time, the plaintiff's lawyer, Andrea Mogensen, said she verbally had agreed to drop the suit, but she still was dealing with the paperwork.
Mogensen estimates the attorney's fees will run between $6,000 and $7,000
