progress in the completion of the checklist that was provided prior to the denial [of the TCO extension]." THE PROCESS On Feb. 21, the county filed an Affidavit of Violation against Bob's Boathouse for oper- ating without a CO. On Jan. 31, the county had issued a Notice of Violation, informing the owners they had 20 days to come into compliance with the 19 outstanding items on the punch list at that time. As of Feb. 21, only three of those 19 items had been addressed, Assistant County Administrator Cunningham notified the county commissioners in a Feb. 24 email. An Affidavit of Violation never should have been issued, Aker argued during the hearing on March 21. "The denial [of another TCO extension in late January] had no nexus to the health, safety or general welfare of the community," he told the Special Magistrate. If it had, the TCO never would have been granted on Oct. 31, 2013, he said. "Bob's Boathouse has had approximately three-and-a-half years to complete construc- tion," Assistant County Attorney Pearce pointed out. "That's why we're here, your honor. They need to finish construction." Among the items remaining to be completed at Bob's Boathouse for it to obtain a Certificate of Occupancy is a watercourse buffer.
